REGULAR TOWN BOARD MEETING

MAY 14, 2007

 

Leair called the meeting to order at 7:00 p.m. Present were Supervisors Carlson, Reid and Morris; Schmittinger was absent. Also present were Administrator/Planner Jeff Herrmann and Clerk Barb Whitmore.

 

Discussion/action – Minutes to be approved – Regular Town Board meeting of April 9, 2007

Carlson made motion to approve the minutes of April 9, 2007, Morris seconded, motion carried unanimously.

 

Monthly report from Wales-Genesee Fire Chief Greg Jezak

Chief Jezak went over the April report; there were 24 calls for the month, 130 as of tonight’s meeting. The semi-yearly fire inspections are about half finished, businesses are being introduced to the knox box ordinance and  responsive to it.

 

The chief attended a meeting on the 800 mHz rebanding on May 7th held at the Waukesha County Administration Center. The radio’s the fire department purchased are not eligible for the replacement grant; the existing radio’s can get a firmware update for the existing radios.  In 5 years the system will change from analog to digital and we will have to replace all of the radios.  The department currently has 28 hand held and 12 mobile.

 

Leair reported the DNR has a burning permit trial going on in 2007. The DNR now has two options for checking the burning restrictions, by call the DNR or checking their website.  She gave the information to the Chief to review.

 

The chief told the Board that Waukesha County Emergency Management is hosting an EOC Recovery Operations Course on July 24th at the Waukesha County Communications Center, he felt someone from the town should go, discussion.

 

The chief asked  a packet of information he had be copied and given to the Board members to review for next months agenda regarding Emergency Vehicle Preemption (EVP), this system allows traffic signals to be changed so emergency vehicles have a green light and the cross traffic is red.  He would like to see these placed at highway 18 & 83; highway 83 and DE; highway 83 & 59; Oakcrest & highway 18; and the proposed intersection for the “cow corner” project.  This will be placed on the June agenda.

 

Discussion/action – Request for Fireworks Sale License –

Big Top Fireworks, - W309 S4839 Commercial Dr.

Herrmann reported the Plan Commission approved this at the April 23rd Plan Commission meeting subject to conditions. The permit will not be signed until they are set up and the premise has been approved by the Fire Chief, discussion.  Carlson made motion to approve the fireworks sales license for Big Top Fireworks subject to the conditions of the Planner and approval of the North Prairie Fire Chief, Morris seconded, motion carried unanimously.

Freedom Fireworks – W292 S4558 Hwy. 59

Herrmann reported the Plan Commission also approved this request subject to the conditions of the Town Planner and approval of the Fire Chief. Carlson made motion to approve the request for the fireworks sales license subject to approval of the Fire Chief and the conditions of the Town Planner. Morris seconded, motion carried unanimously.

 

Discussion/action – Request for second driveway – Paul Fleckenstein, Seville Lane

Herrmann showed the Board aerial photos of the lot.  This had been two lots; Mr. Fleckenstein purchased one of the lots, tore down the house and built a tennis court. He is in the process of combining the two lots. Herrmann stated he had no problem with the second access, it is the original drive and there are no site distance issues. Carlson stated he agreed.

 

Carlson made motion to approve the request for the second driveway as it is an existing driveway and could do more damage to the road if it were removed.  Morris seconded, motion carried unanimously.

 

Discussion/action – Request for second driveway – Randolph Vancura, Spring Ridge Lane

Herrmann also had an aerial of this lot, explaining the house faces Spring Ridge Lane and the second driveway request is for a garage facing Gatekeeper Court, and there is one other driveway on Gatekeeper which is a cul-de-sac that will not be extended, discussion.  Carlson stated he also had no problem with this request. 

 

Carlson made motion to approve the request, due to circumstances he would have to cross the whole lot to get to the garage, Gatekeeper is not a through road, there is only one other driveway on the cul- de-sac.  Morris seconded, motion carried unanimously.  Vancura was reminded he will need to complete a culvert application before the culvert is installed.

 

Discussion/action – Request for temporary Class “B” fermented malt beverage and “Class B”   Wine Picnic License on July 14, 2007 - 1st Congregational Church of Genesee

Whitmore told the Board the request is the same as in years past, the church is having a pig roast on July 14th from 4:30 to 8:00 p.m.  The beer and wine would be sold in the narthex area of the Educational Building; the premise would be the dining area, narthex and outside tent for bingo.  Discussion, Leair stated there have been no complaints in past years.  Carlson made motion to approve the picnic license the 1st Congregational Church of Genesee on July 14, 2007 authorizing underage persons to be on the premise for which the license is issued from 4:30 to 8:00 p.m. Morris seconded, motion carried unanimously.

 

Discussion/recommendation - Request for fireworks at private party at Genesee Sunset Park

on 7-3-07 – Richard Werning/Kelly Renner

Richard Werning, town resident and Kelly Renner were present to discuss a request to have fireworks on July 3, 2007 at Sunset Park for 35 to 40 minutes for a private party of 30 to 40 friends. Renner said he has taken a class and is licensed by the ATF to do class B fireworks. They also request the park stay open until 10:30 p.m. so they would have time to pickup afterwards.

 

Leair stated that the town has never permitted fireworks in the parks unless they were town sponsored, that an approval would set a precedent.  Reid was also concerned about the liability to the town.

Reid made motion to deny the request for fireworks at Sunset Park, Carlson seconded, motion carried unanimously.   Werning was told he could apply for a license to possess and display fireworks permit through the town office for his residence.

 

Discussion/action – Request for outdoor music on June 10, 2007 – Mike & Jody Schuenke

Jody Schuenke was present to request to have outdoor music on June 10, 2007 for her daughter’s graduation from around 3 p.m. to 9:00 p.m. they will be playing on and off, not all the time. They did the same type of party 4 years ago and had no problems or complaints; they are inviting neighbors, discussion on parking.  Morris made motion to approve the request for outside music on June 10th from 3 p.m. to 9 p.m. for Mike and Jody Schuenke on Bethesda Circle, Reid seconded, motion carried.

 

Update on survey of town property, Outlot 1, McFarlane Manor

Herrmann told the Board he had walked the site and had pictures of the area that the Board reviewed. He asked what they wanted to do next, discussion.  Brad White whose property is next to the public easement told the Board he trimmed the trees today to help define the access.  The Board directed Herrmann to send letters to the neighbors stating the town will continue to monitor the area and to purchase and post “No ATV’s” signs. 

 

Discussion/action – Public Facility Needs Assessment & Impact Fee Study for Park Facilities

Herrmann told the Board he met with Ron Hill to discuss what plans the Park Board had for the parks over the next few years.  Some of the projects the Park Board would like to do in the future at Sunset Park are an additional shelter with restrooms, benches, and reroofing of buildings.  The numbers were re-run and the new numbers are a studio or one bedroom dwelling unit $379.00 this was $329.00; two bedroom dwelling units changed from $439.00 to $506.00 and three or more bedroom dwellings or single family home changed from $658.00 to $759.00, these numbers are more in line with where we felt they should be.  He will work with Attorney Macy on the ordinance and have it on an upcoming agenda.

Patching & Paving Contract

Carlson reported the patching has been started, he is finishing the list of roads to be paved.

 

Sand Sweeping Contract

The sweeping should be completed soon.

 

Landfills in the Town of Genesee – Gordy Carlson

CTH’s “D” & “E” – Backhaus property

Carlson reported the Backhaus property site near highways D and E looks alright

 

Highway 83 – Roe/Mahan property

There is some brush growing at this site, Carlson will notify the residents to remove them.

Chairman – Sharon Leair

Status of legislation effecting towns

The Urban Town’s are still working on the Charter Town’s bill.

 

The video bill has gone back into committee; municipalities that have agreements with the cable companies can be broken as they are not recognized as contracts by the state. Of concern to the town is the protection of our right of ways and franchise fees.

 

The levy limits are not decided for the next budget

 

There may be changes in the impact fee laws, that the funds use will be changed from 7 to 10 years.

 

Update from WTA Waukesha Co. Unit on 4-25-07

The transportation fee increase is set for 2%, the Towns Association is trying for 5%.       

 

Supervisor – Drake Reid

Report on Waukesha Co. Cooperation Council Meeting of 4-30-07

Reid reported Johnson Controls, Inc. gave a report on going green and environmental activities in the county.  Long term recycling needs in the county was also discussed.  Board members were copied with the minutes that meeting.

 

Report on 800 mHz Rebanding Meeting on 5-8-07

Reid said the Chief’s report covered the meeting on the 800 mHz, he really had nothing to add.

 

Administrator – Jeff Herrmann

Update on NR216 Agreement with Waukesha County

Herrmann reported Yaggy Colby has applied for a MS4 permit grant

 

Herrmann also reported the Intergovernmental agreement with Waukesha County with Waukesha County will be on next months agenda for action; he will copy the Board with letters from John Macy and Perry Linquist regarding this agreement.

 

Update on Waukesha County Zoning Code Amendments

Leair reported the county still has the amendments the four towns have been working on.

 

Herrmann told the Board the Pebble Creek Watershed Protection Plan covering parts of Delafield, Genesee, Pewaukee and Waukesha is here if they would like to review it. This plan is advisory only; the committee would like the town to adopt the plan, Herrmann will talk to Attorney Macy about a resolution to acknowledge the plan rather than adopt it so it doesn’t conflict with our land use plan.

Memorial Day Service at Town Park

Whitmore reported the VFW will again hold a Memorial Day Ceremony on Sunday May 27th at Town Park at 1 p.m.  State Representative Steve Nass will be the guest speaker, a free picnic lunch will follow.

Treasurer – Carol McCormick

Update on unpaid 2006 personal property taxes

McCormick gave the Board a list of unpaid personal property taxes. The 2005 taxes have been charged back and paid.  She is working on the 2006.

 

Discussion/action – Bills to be presented

Carlson made motion to approve the bills as presented, Reid seconded, motion carried unanimously.

 

Correspondence

Leair reported she is planning a meeting with Jeff, Dale Shaver and Bill Mitchell to present an amendment to the county that was signed by the eight Chairmen of the towns that do their own plans of operation, the four past and four new Chairmen of the towns that are under county zoning to allow us to do our own plans of operation. Eventually this should go to the County Board; this would not apply to Shoreland issues.

 

A letter was received from the state DOT about a preconstruction meeting for the intersection of highways 18 and C on May 21st. 

 

The county will begin resurfacing work on CTH “C” from “G” to Morris Road and on CTH “DE” from highway 83 to Boettcher Rd. The works should start around the beginning of June and be complete in late August.

 

Whitmore reported we have received letters from the Environmental Health Department that the wells at the Town Hall, Sunset Park and Town Park have all come back with no evidence of bacterial contamination.
