REGULAR TOWN BOARD MEETING

SEPTEMBER 10, 2007

Leair called the meeting to order at 7:02 p.m. Present were Supervisors Morris, Reid and Schmittinger; supervisor Carlson was absent. Also present were Administrator/Planner Herrmann and Clerk Whitmore.

Discussion/action – Minutes to be approved

Regular Town Board Meeting of 8-13-07 - Schmittinger made motion to approve, Morris seconded, motion carried with Reid abstaining. Adjourned Board of Review of 8-20-07 – Morris made motion to approve, Reid seconded, motion carried unanimously.

Monthly report from Wales-Genesee Fire Chief Greg Jezak

Chief Jezak went over the monthly report that Board members had received copies of. There were a total of 38 calls in the month of August with a total of 238 runs through the end of that month.

A discussion followed on the report on the response times. The Chief will get the town information regarding the different sections of the town and the number of calls in each as these numbers may help with the smart growth plan.

The Chief also reported the department has sent out a letter to all businesses in the town and village requesting donations for the emergency vehicle preemption equipment for the trucks. As of this evening the department has received $3,025.00.

Discussion of possible amendment to Town Burning Ordinance – Chief Jezak

Discussion on the size of pits for burning, the Chief has come across several where people were burning without permits in very large pits, anywhere from 15 to 20 feet in length and 5 to 6 feet deep. It was agreed this would be a judgment call if a permit would be required, the location would be a key factor. There will be no amendment to the ordinance at this time.

Discussion/action – Request for outside music and parking on town road – Helen Brady,

S34 W32585 Sierra Pass

Mr. and Mrs. Brady were present to discuss their request to have outside music at a party at their home on September 29, 2007. Parking would be in their driveway, some on the lawn and the rest along the side of the road. They understand the cars have to be off the road as much as possible and only along one side to allow for emergency vehicle access. The live music will be from 7:30 p.m. to 10:00 p.m. Board members advised they contact their neighbors to let them know they will be having outside music until 10:00. Schmittinger made motion to approve the request of Helen Brady to have outside music on September 29th from 7:30 pm to 10pm, Morris seconded, motion carried unanimously.

Discussion of ordinance to require a use permit for Town Parks Athletic Fields

Herrmann told the Board he and Ron Hill will work on this, they would like to have a card they can give out with the dates and times the fields are reserved for use, discussion. It was suggested a sign also be placed on the fields stating the field is reserved at certain times. They will work with the recreation director, as he schedules the fields. They want to have the cards implemented for use in 2008.

Discussion/action – Final Acceptance – Release of Letter of Credit (maintenance bond)

A portion of Wolf Road - Herr Environmental

Herrmann and Carlson inspected the road and reported the letter of credit could be released. Morris made motion to approve the release of the letter of credit for Herr Environmental, Schmittinger seconded, motion carried unanimously.

A portion of Harvest View Drive – Smart CSM #10

Herrmann reported this can also be released. Morris made motion to approve the release of the letter of credit for Harvest View Drive on October 9, 2007, Schmittinger seconded, motion carried unanimously.

Fox Run Court – BB McGee, LLC

Herrmann asked this be approved subject to a final inspection since the letter of credit does not expire until November 13th. Schmittinger made motion to approve the release of the letter of credit for Fox Run Court subject to a final site inspection, Morris seconded, motion carried unanimously.

Discussion/action – Request to extend Developers Agreements for final placement of final lift

Herrmann explained we would like to extend the placement of the final lift of asphalt in these subdivisions since there has been little construction; he has spoken with Bonnie Schaefer from Neumann Development and Barb has talked with Bob Hamilton regarding Brookhill Heights, he has been unsuccessful in reaching Harmony Homes, discussion.

Kettlefields – Harmony Homes

Discussion on the date for the extension, it was decided to request the extension be for 13 months since they probably would not be able to have the final lift in place by the 1st of June. Schmittinger made motion to approve the extension for the final lift of asphalt to be placed in Kettlefields to July 1, 2008, Morris seconded, motion carried unanimously.

Brookfield Heights – Construction Management and The Ridge at Genesee – Neumann Development

Schmittinger made motion to approve the extension of placement of the final lift to October 1, 2008 for Brookfield Heights and to October 31, 2008 for The Ridge at Genesee, Morris seconded, motion carried unanimously.

Discussion/action – Ordinance 07-02, An Ordinance to Regulate Parking, Stopping or Standing Of Vehicles on Town of Genesee Roads

Herrmann gave the Board two proposals for an ordinance; the first one covers the entire town. He spoke with attorney Macy and he questioning how the ordinance would be policed. That someone could move a vehicle every 23 hours and be in compliance with the 24 hour time frame. The second proposal deals only with two roads, Little John Drive and Old Village Road, discussion. A letter was received from Beth Partleton and Vernon Vice regarding the parking ordinance and Little John Dr.

Schmittinger made motion to approve Ordinance 07-2 (the second proposal) changing the title to - An Ordinance to Regulate Parking, Stopping or Standing Of Vehicles on Certain Town of Genesee Roads. Reid seconded, motion carried unanimously.

ORDINANCE 07-2

AN ORDINANCE TO REGULATE STOPPING,

STANDING OR PARKING OF VEHICLES ON

CERTIN TOWN OF GENESEE ROADS

The Town Board of the Town of Genesee, Waukesha County, Wisconsin, has the specific authority under s.349.13, Wis. Stats, to adopt this ordinance.

The Town Board of the Town of Genesee, by this ordinance, adopted on proper notice with a quorum and by roll call vote by a majority of the town board present and voting, provides the authority for the town to regulate the stopping, standing, or parking of vehicles on town highways in the town as follows:

A.

Town of Genesee is subject to the following restrictions and limitations:

Little John Drive – Parking on the road and shoulder are prohibited.

Old Village Road - Parking on the road from Highway 83 to Church Street is prohibited from November 1st to April 1st from 6:00 p.m. to 6:00 a.m.

B.

the above described highways on or before the effective date of this ordinance

C.

This ordinance is effective on publication or posting on the __ day of ___________, 2007.

The town clerk shall properly post or publish this ordinance as required under s.60.80, Wis. Stats.

Discussion/action – Approval of Gold Seal Support Program with Phones Plus

Discussion of the support program for another year for the Town Hall phone system. Schmittinger made motion to approve payment of the support system for another year, Morris seconded, motion carried unanimously.

Discussion/action – Operator Permit Applications

Schmittinger made motion to approve the renewal license for John Ceille at St. Paul’s Catholic Church, Morris seconded, motion carried unanimously.

Reports –

Chairman – Sharon Leair

Report on Towns Association County Unit Meeting

Leair told the Board that Neal Kedzie and Steve Nass were at the Town’s Association meeting last week and told the town’s to figure next years budget based on the 2% levy increase, they have no idea when the budget will be completed.

Leair was also elected Chairman of the Waukesha County Unit of the Wisconsin Towns Association for the next two years. The County Unit Meeting on October 24th will be held in Genesee.

Roads – Gordy Carlson

Patching Contract and Brushing & Weed Cutting Contracts

Whitmore told the Board that Carlson had asked her to report that the paving over the two culverts on Bethesda Circle has been completed.

County Communications Center Program – Drake Reid

Waukesha County Cooperation Council Meeting of July

Reid told the Board the minutes of the meeting pretty much cover what was discussed, the main part of the discussion was addressing the response times of the emergency personnel. They also addressed how sound addressing practices also fit with the response times.

Administrator – Jeff Herrmann

Smart Growth update

Herrmann reported there was discussion on the extra-territorial zoning; he felt this would not be an issued for the town. He reminded Board members to review the objections, standards and policies for the meeting on the 19th.

Treasurer – Carol McCormick

Update on unpaid 2006 personal property taxes

McCormick said there is no change in the unpaid personal property tax bills.

There was a fax this evening from the fire department for the 2% dues.

Discussion/action – Bills to be presented

Morris made motion to approve the checks as presented and to add a check to the Joint Fire Board for the 2% dues in the amount of $13,938.40. Reid seconded, motion carried unanimously.

Correspondence

Leair reported the town is still working with the county regarding the Stormwater Agreement.

Whitmore reminded the Board the Wisconsin Towns Association annual convention is October 21 to 24th in Green Bay, she has registration papers if anyone is interested.

Schmittinger made motion to adjourn, Morris seconded, motion carried unanimously. Meeting adjourned at 8:50 p.m.
