Leair called the
meeting to order at 7:00 p.m. Present were Supervisors Carlson, Morris, Reid
and Schmittinger. Also present were Administrator/Planner Herrmann and Clerk
Whitmore.

Monthly report from Wales-Genesee Fire Chief
Greg Jezak
The Chief
reported the department has had 333 calls as of today, 33 calls in November. He has received approval of a DNR grant for around $4,000.00
for wild land firefighting gear, and has applied for a fire prevention grant
for a survive alive house.
The chassis has
been ordered and should be done in mid January then it will go to Medtec and should be done in around 4 months. The old ambulance will be put out for bid to
sell.
Discussion/action – Acceptance of resignation
letter of Tim Schmidt, Joint Fire Board
A letter was
received from Tim Schmidt effective December 31, 2007, however a replacement
has not been found as of this date, Schmidt has agreed to stay into
January. Carlson made motion to table
action on the resignation and appointment to the Fire Board until the January
Town Board meeting, Morris seconded, motion carried unanimously. Discussion of suggestions
by Schmidt that the Town investigates consolidation and reviews the vehicle
replacement list and an employee manual.

Discussion/action – Approval of Understanding
of Service Letter for Audit and Financial Services – Rotroff Jeanson &
Company
Understanding of
Service Letter for the year ending on December 31, 2007, explaining the
additional requirements are through the AICPA (American Institute of Certified
Public Accountants). There are eight
risk assessment factors the auditors must look at which are Howard Jeanson of
Rotroff Jeanson and Company was present to discuss the changes in the applicable
to all audits. Their company (Rotroff Jeanson) is audited every three years to
check that they have done these assessments. The up to $3,500 is a onetime
charge for the additional work for the 2007audit. A report will come back to
the Board on the audit findings.
Morris
made motion to approve the Understanding of Service Letter for Audit and
Financial Service from Rotroff Jeanson and Company, Carlson seconded, motion
carried unanimously.
Discussion/action
– Request to lower Letter of Credit – Stoneridge Estates, Fred Spytek
Leair read a letter from Town Engineer Bob Gassert dated November 27th recommending the letter of credit for Stoneridge Estates be reduced by $80,844.00 to a new amount of $241,755.00, discussion. Carlson made motion to approve the reduction of the letter of credit for Stoneridge Estates by $80,844.00 to a new amount of $241,755.00, Reid seconded, motion carried unanimously.

- Approval of Ordinance 07-3 Approving the Detachment of Property within the
Boundary Agreement Area Under the Municipal Boundary Agreement with the Village
of Wales – Roberts property, Brandybrook Road
Herrmann has reviewed the legal description and it is correct, the Village of Wales has also approved the attachment on November 19th. Morris made motion to approve Ordinance 07-3 approving the Detachment of Property within the Boundary Agreement Area Under the Municipal Boundary Agreement with the Village of Wales, Carlson seconded, motion carried unanimously.
Discussion/action
– Amendment to Ordinance 06-12, Solid Fuel Heating Devices
This was discussed at the November meeting, changing the language in section 1 (c) from 200 feet to 400 feet, Morris made motion to amend ordinance 06-12 by Ordinance 07-4 to amend the Solid Fuel-Fired Devices, Carlson seconded, motion carried unanimously.

AN ORDINANCE TO AMEND SOLID FUEL-FIRED HEATING DEVICES LOCAL ORDINANCE REGULATING THE USE OF SOLID FUEL-FIRED OUTDOOR HEATING
DEVICES WITHIN THE TOWN LIMITS OF THE TOWN OF GENESEE,
WHEREAS, the Town of
Genesee adopted an Ordinance regulating the use of Solid Fuel-Fired Outdoor
Heating Devices within the Town limits of the Town of Genesee; and
WHEREAS, the Town
Board of the Town of Genesee finds that it is reasonable to amend the distance
of such heating devices from residences,
NOW, THEREFORE, the
Town Board of the Town of Genesee, Waukesha County, Wisconsin DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1: Town of Genesee Ordinance No. 06-12 entitled “Solid Fuel-Fired Heating Devices Local Ordinance regulating the use of Solid Fuel-Fired Outdoor Heating Devices within the Town limits of the Town of Genesee, Waukesha County, Wisconsin, dated October 9, 2006,
Section 1 (D) entitled Outdoor Solid Fuel-Fired Heating Device Provisions, Subsection (1)(c) is
hereby repealed and recreated as follows:
The outdoor solid fuel-fired heating device shall have a chimney that extends at least 15 feet above the ground surface. If there are any residences within 400 feet, the chimney shall also extend at least as high above the ground surface as the height of the roofs of all such residences. All stacks shall be equipped with a cap having a spark arrester.
SECTION 2: EFFECTIVE DATE.
This ordinance shall
take effect immediately upon passage and posting or publication as provided by
law.

Discussion/action
– Resolution 07-9R Requiring the Routing of all
Geo-Referenced Subdivision, Plats and Certified Survey Maps to the County
Land Information Office upon approval
Herrmann told the Board the Town Attorney recommended the town not approve this, the town does not want the responsibility of filing the maps, and the county has ready access to the maps. Discussion, no action was taken.
Discussion/action
– Contract Review cover Sheet as suggested by Attorney John Macy
Herrmann reviewed the letter regarding the routing steps
for a contract review, many we ordinarily do. A lot of the steps on this form
the town do not have the staff to cover, discussion. No action taken.
Discussion/action
– Amendment to Ordinance 01-4, Nonmetallic Mining Reclamation
Herrmann went over the amendment to Ordinance 01-4, to bring the town’s ordinance in compliance with the state ch. NR 135 administrative Code requirements. Discussion on the fee schedule, if the town should raise their fee‘s as the DNR has changed their fees. It was decided the fee schedule should remain the same. Schmittinger made motion to approve Ordinance 07-5,
to amend the Nonmetallic Mining Reclamation Ordinance within the Town Limits of the Town
of Genesee, Waukesha County, Wisconsin, and to strike section 9 changing the fee schedule, Carlson seconded, motion carried unanimously.

AN ORDINANCE
TO AMEND NONMETALLIC MINING RECLAMATION ORDINANCE WITHIN THE TOWN LIMITS OF THE TOWN OF
GENESEE,
WHEREAS, the Town of
Genesee adopted an Ordinance to establish a local program to ensure the
effective reclamation of nonmetallic mining sites on which nonmetallic mining
takes place in the Town of Genesee in compliance with Chapter NR 135, Wisconsin
Administrative Code and Subchapter 295, Wisconsin Statutes; and

WHEREAS, the Town
Board of the Town of Genesee finds that it is reasonable to amend the Ordinance
to comply with recent changes in Chapter NR 135, Wisconsin Administrative Code
and Subchapter 295, Wisconsin Statutes,
NOW, THEREFORE, the
Town Board of the Town of Genesee, Waukesha County, Wisconsin DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION 1: The Nonmetallic Mining Ordinance for the Town
of Genesee, Section 11 entitled Nonmetallic Mining Reclamation Permit
Application, Subsection 11.10 entitled Required Submittal, is hereby repealed
and recreated to read as follows,

15.40 Permit Issuance for New Mines.
Applications for reclamation permits for nonmetallic mining sites not
permitted under sub 15.20 that satisfy sub. 11.30 shall be issued a reclamation permit or
otherwise acted on as provided in Section NR 135.21(1), Wisconsin
Administrative Code. The permit shall require compliance with a reclamation
plan submitted by the applicant that conforms with sub.
12.30, and provision by the applicant of financial assurance that
conforms with sub. 13.30 payable
to the Town of
SECTION 8: The
Nonmetallic Mining Ordinance for the Town of Genesee, Section 15
entitled Issuance of a Nonmetallic Mining Reclamation Permit, Subsection 15.70
entitled Permit
Conditions, is hereby repealed and recreated to read as follows,
15.70 Permit Conditions. Permits issued under this section may include
conditions as provided in Section NR 135.21(2),
Wisconsin Administrative Code. One required condition
shall be that new mines shall obtain financial assurance prior to beginning
mining pursuant to Section NR 135.40, Wisconsin Administrative Code.

– Approval of 2008/09 Election Workers
Whitmore told the
Board this is the list of election Workers she has as of today, she would like
to add the names of Christy Connell and Michelle Varik,
and this is for a two year term. They will be talking a class for certification
on January 15th here. She
also said she will need several more workers.

Discussion/action
– Approval of 2008 Fire and Rescue Contract with the Village of North Prairie
Herrmann told the Board he had no problem with the contract, however the current contract does read they are to give us 60 days notice when fees are changed, and there was no notice given, discussion. Board members agreed a letter should be sent with the renewal that this should be discussed during the budget process, and the Town will not approved fee changes in the future without the 60 day notice. Discussion of the proposed fee changes.
Schmittinger made motion to approve the contract with the changes to be coordinated with the fees to be equal to the charges of the Wales-Genesee Fire Department, Carlson seconded. Schmittinger stated he will talk to Gary Nickerson about a meeting to look at ways of saving money, and long range planning. Motion carried unanimously.

Leair told the Board the Engineer has completed the report on the Vidmar drainage and it has been sent to Mr. Vidmar’s attorney. Because there wasn’t a copy of a report for all Board members, she asked them to stop by the Town office at their convenience to read the report. She mentioned the possibility of a meeting in January 2008, regarding same.

2007/08 Snow and Ice Control Contract
They’ve been out plowing, we’ve received some complaints. Whitmore reported the snow budget is over by $146,954.03 as of the 5th.
We received word that the Town will receive a $18,140.58 grant from the Trip program through the state next year for road repair.

Copies of several newspaper items regarding the speed limit on Saylesville Road were copied to all Board members. County Supervisor Bill Mitchell was present and told the Board he has asked the county to reduce the speed limit.

Update on unpaid 2006 personal property tax bills
McCormick reported there is no change on the 2006 unpaid personal property taxes.
2007 property tax bills
The 2007 tax bills have not been printed or mailed yet, they hope to have them out by the week-end.
Update on Dog License
McCormick reported there are quite a few delinquent this year; she will try to catch them when they come in this year.

Whitmore told the Board she will be paying the Joint Fire Board, state and federal taxes and nationwide later his month, the Joint Board doesn’t meet until the 12trh.
